Empire Coke Settlement Release

Birmingham, Alabama — The Empire Coke facility closed in 2004, almost eight (8) years ago. Before closing it provided well-paying jobs to many people in and around the Holt area, and was operated safely, met or exceeded standards for pollution control, and complied with applicable State and federal regulations.
We were very surprised when these suits were filed, particularly in light of the fact that the facility had been closed for so long and none of the community residents had filed such complaints while the facility was in actual operation. Empire was one of several industries operating in that area, and there is no factual, medical or scientific link between the plaintiffs' complaints to our plant. Nevertheless, in an effort to put this matter behind us and avoid a protracted and expensive legal fight we have reached a mutually agreeable resolution.
